Health Guarantee

 
 

Seller certifies the puppy is in good health at the time of sale, has received age-appropriate vaccinations and deworming, has been examined by a licensed veterinarian, and will be accompanied by available health records. 

Buyer must have the puppy examined by a licensed veterinarian within seventy-two (72) hours of taking possession. Failure to do so voids all health guarantees. 

Seller provides a two (2) year health guarantee against life-altering hereditary or congenital defects that substantially affect the dog's quality of life. Buyer must immediately notify Seller and provide veterinary records. Seller reserves the right to obtain a second opinion. Seller may, at Seller's discretion, replace the puppy or refund the purchase price upon return of the dog. 

No veterinary expenses are reimbursed unless agreed to in writing before treatment.

 
 

Parasite Disclaimer

 
 

Seller follows an age-appropriate parasite prevention program. However, parasites may have dormant or incubation stages and may not be detectable during examinations or fecal testing. Seller does not guarantee the puppy to be free of internal or external parasites. Buyer accepts responsibility for routine parasite prevention and treatment after transfer of possession.

 
 

Health Exclusions

 
 

This guarantee does not cover accidents, neglect, abuse, obesity, improper nutrition, parasites, infectious disease contracted after transfer, allergies, hernias, cryptorchidism, bite changes after eight weeks, ear carriage, adult size, coat quality, color, or other cosmetic traits.



No Guarantees



Seller makes no guarantee regarding: Show quality, future temperament, adult weight, adult height, adult ear set

or adult coat texture.  These characteristics can change as the puppy matures.



Spay/Neuter Requirement

 
 

Unless specifically granted breeding rights in writing by Seller, this puppy is sold as a companion animal only.

Buyer agrees to have the dog spayed or neutered no later than twenty-four (24) months of age, unless a licensed veterinarian determines that delaying or foregoing the procedure is medically necessary. If a medical exception exists, Buyer shall provide Seller with written documentation from the attending veterinarian.

Buyer agrees to provide Seller with proof of spay or neuter, including a copy of the veterinary invoice or medical record, within thirty (30) days of the procedure.

Failure to comply with this provision shall constitute a material breach of this agreement and may result in Seller pursuing all remedies available under this contract and applicable law, including enforcement of the unauthorized breeding provisions if the dog is bred without Seller's written authorization.

This requirement does not apply to dogs for which Seller has granted breeding rights in a separate written agreement.

 
 
 

Buyer's Responsibilities

 
 

Buyer agrees to provide proper food, water, housing, veterinary care, parasite prevention, exercise, training, socialization, and licensing.

 
 

Refund Policy

 
 

Except as specifically provided in this agreement, all sales are final. 

If Seller accepts the return of a puppy for any reason not covered by the health guarantee, any refund shall be reduced by Seller's actual expenses including food, veterinary care, medications, vaccinations, boarding, travel, transportation, advertising, grooming, and other reasonable costs. 

If the puppy is resold for less than the original purchase price, the difference between the original purchase price and resale price shall also be deducted from any refund.

 
 

Return of Dog

 
 

If Buyer cannot keep the dog at any time, Buyer must first offer the dog back to Seller. The dog may not be sold, gifted, transferred, or rehomed without first notifying Seller. Seller may take the dog back, assist with placement, or approve a new owner.

 
 

No Shelter Surrender

 
 

Buyer shall not surrender the dog to any shelter, rescue, broker, auction, research facility, or pet store without Seller's prior written consent.

 
 

Deposit / Reservation

 
 

Deposits and reservation fees are non-refundable. Buyer may transfer the deposit or reservation fee to any future litter bred by Seller. There is no limit to the number of transfers, subject to puppy availability and continued communication with Seller.

 
 

Delayed Pickup

 
 

Unless otherwise agreed, puppies not picked up within seven (7) days of original go home date will incur boarding charges of $50.00 per day.

 
 

Registration

 
 

Limited Registration paperwork will be provided after payment in full and compliance with all terms of this agreement.

 
 

Temperament

 
 

Seller makes no guarantee regarding future temperament, behavior, trainability, or compatibility, as these depend upon genetics, environment, training, and socialization after sale.

 
 

Breeding Rights

 
 

Breeding rights are granted only by separate written agreement. Unauthorized breeding, semen collection, embryo collection, or producing a litter from a dog sold without breeding rights is strictly prohibited. 

Buyer agrees that unauthorized breeding causes damages that are difficult to calculate and agrees to pay liquidated damages of $10,000.00 for each unauthorized breeding or litter, in addition to any other remedies available under Arizona law.

 
 

Limitation of Liability

 
 

Seller's maximum liability shall never exceed the original purchase price of the puppy.

 
 

Attorney's Fees

 
 

The prevailing party in any legal action arising from this agreement shall be entitled to recover reasonable attorney's fees and costs to the extent permitted by Arizona law.

 
 

Governing Law

 
 

This agreement is governed by Arizona law. Venue for any legal action shall be Cochise County, Arizona, unless otherwise required by law.

 
 

Entire Agreement

 
 

This document constitutes the entire agreement between Buyer and Seller. Any modification must be in writing and signed by both parties.
